I don't have the problem on my '08 model, but the indicator for the tailgate is shown in your '09 owners manual on page 4-45 - tell that tech to read!
it says:
This warning light illuminates when the tailgate is not closed securely with the ignition switch in any position.
 
The sensor is located behind the latch assembly.

yes, it was the latch assembly.
 
now the warnig light is working, and it doesn't lock the doors after 30 seconds when i only have the tailgate open, but i'm surprised that it doesn't turn on the dome light when you open the rear hatch. is it normal?

Unfortunately it is normal, one of the dumb changes they made with the '08 models. The '07 had a side cargo light and then for some stupid reason they removed it in '08 and didn't wire the tailgate into the rear dome light. It can be done (a member on another forum has done it) but its not an easy task. A few people have just put in the cheap stick on lights or you can keep pushing the remote every 30 seconds or reach in and turn on the dome light but some people can't reach it from the back.
