Acura MDX warped rear spoiler defect

I have a 2008 Acura MDX that I purchased new and have driven 10k miles in about 6 months. Last weekend when the thermometer hit 100F, I heard a crack as I started to open my rear door/hatch. I looked up and noticed that the spoiler appeared to have warped (possibly due to heat?) and dug into the roof. I closed the door and tried to re-open it but could not open it more than a few inches before it crunched. The spoiler is now bent and there is now a small dent in the roof. It also looked as though some of the rubber was coming off the hatch. I took the car to the dealer today and was told that they had never seen this before so I would have to bring it back in a couple of days when a factory rep would be visiting. I agreed to do so but needless to say I was not too pleased with that response as there is no question this is a warranty item - it is either defective materials (plastic fatigue) defective workmanship and/or defective design. The sales manager intimated that it was possible the damage could have been caused by collision but I think it would be impossible to damage the top panel in one spot and the door/spoiler in another by hitting something nor would it possible to drop something on the car and do the same kind of damage given the location. Has anyone else had this problem? |
