I am having the same problem. I took the advice to call American Honda. After a detail explanation of the problem, the operator refused to help me. She was trying to be nice since I was very polite to her. The final answer was - too bad, you got a Honda, and I was not going to help you. I am not sure why Honda is not listening. I am sorry that I have not find this site before I got my lemon. Now, I don't know what to do? Please help me. I can't afford to sell the car, and buy another one. Last Honda for me. I am going to Saturn.

From the original description (downward recal & loss of regen), it sounds like the battery is acting up in a way that the MCM understands, but that it doesn't think is a fatal problem. A downward recal (battery dropping to zero) happens when the MCM discovers that what it thinks the battery's charge is does not match reality. It then drops the gauge to zero and applies what looks like a force charge (but is not) to try to evaluate the battery. During this period, regenerative braking is unavailable.
In your case, the MCM is then determining that the battery is still usable and is not generating an IMA light. Honda's official policy is to "not fix what ain't broke" and deny claims where the MCM still thinks the battery is okay - because it is okay to drive.
This process will continue and the battery will continue to degrade until the MCM finally gives up on the battery. At that time, Honda will replace it.
Disclaimer: I could be wrong and it could be a false battery problem where the MCM thinks there is something wrong with the battery and there is not - but I doubt it.
JoeK11's battery is acting up only under heat. I've seen cells that only fail when heated - but they are rare. Usually, they'll be weak enough when cool to detect.

The owner says he had it for 20k miles and runs good and gives between 45 - 50 mpg
This car has a salvage rebuilt title and only 33000 miles
what should be my concerns

I would worry more about the title issues. Who did the rebuild, and what kind of accident was it? There are horror stories of people being injured in rebuilt cars because the air bags weren't properly fixed, along with other problems.
If you have major IMA issues the light will come on. However, if you read this thread you will see that there can be issues without seeing the light on. At a minimum take it to a dealer for a complete checkout, and make sure that you can return it if the dealer finds a problem. (Note: find a dealer with experience fixing the hybrids!)

If the IMA light is not on, then you don't have any IMA problems yet, but if the car sat for months as it was rebuilt, the battery may die toward the end of the first year you own it. This is not a disaster as it can be rebuilt fairly cheaply, but you need to plan ahead for what will likely happen.
Typically, a car will take at least 45 days to go from collision to auction block. Then the car was repaired. During this time, the battery was sitting without being charged up. In my experience, a battery with several years on it will die with a P1447/P1433 error 9 months (+/- 2 months) after it has been left to sit for 90 days or more.
Budget about $1000 and three weeks to fix it.

Please let me know if you have found a resolution, am off to pick up my 06, they say it is normal??? Mpg had decreased from 40 to 34-35, IMA was fine until recently, 107,000 miles and it is not working like it did before and worse since the update on Monday Aug 10, 2009. Am so frustrated, same story, American Honda is not taking responsibility for this, says its working normal, but normal is NOT normal! Going to schedule a Factory Rep test drive. Any suggestions?

I have read throughout this thread and think a lot of the problem is with the individual dealers. I had the same problem described with the battery going to nothing within 30 of driving on hot days. This is a major problem for me since I live in the Keys and cannot get anywhere without going on a 55mph (75-90mph actual) highway and need to merge onto the road within 300 yards of leaving my house. As anyone with a Civic Hybrid can understand, going from 0-55 without assist takes forever and can be dangerous if you are trying to merge. I took the car to my nearest dealership some 120 miles away last week and they said there were no error messages or codes, but there were 3 computer software updates that needed to be completed on the car and this may clear up the problem. They did the updates and we drove it around. The problem was not totally fixed, but did seem to be better until Saturday (4 days and 400 miles after the updates) when the check engine and IMA lights came on and locked in. I hooked up my OBD-II reader and the car said the probem was P0A47: Hybrid Battery Pack State of Charge Low. I contacted the dealership and they told me to bring the car back for them to look at it. It turns out the battery pack was bad and THE SOFTWARE UPDATES RECOGNIZED THIS WHILE THE PREVIOUS SOFTWARE DID NOT. They ordered the battery yesterday and the car is now done and fixed (one day to get the battery). They gave me a loaner and eveything was very smooth!!
So, for those of you cursing Honda and blaming Honda Corporate, maybe the problem is with your dealership and not Corporate. I would insist they update the software and then give it some time to recognize the problem so they can replace the battery. The dealer cannot replace the battery under warranty without the computer print outs stating the battery is indeed bad. I have always trusted Honda's reliability and quality and while there is a problem with the battery in high heat, I think those of you who are on this blog complaining of the Hybrid Battery problem, may have jumped the gun at cursing Honda and may need to work more with your dealer to get the problem fixed!!!

You may be right about the dealer, but when you hit a brick wall continually, made to feel that you are off your rocker and they think you're making things up, its difficult to see through the frustration. I talked to 4 other dealers in the area, dropped it off yesterday in Lodi (has always been serviced in Elk Grove, Ca) for their opinion, they left me a message that they found another software update (why E.G. didn't know about either and did d/l the one after I informed them from researching the internet that someone suggested it). The second one does not allow the car in auto stop if the battery needs to be charged, how that will affect mpg or performance will find out when I p/u the vehicle shortly. Why aren't updates a part of a notification system to the consumer? Service bulletin for Control arms for my auto was issued 6 months after I had put new tires (wear cupping) but was not notified because it was not a recall. I would have liked American Honda/Dealer to at the very least discount the tires. Thanks for the info, have printed it out and will give it to the Lodi dealership, hope this update fixes the problem, or causes the error codes.

Nublett - was wondering if you could please post some more info on the specific software updates that were done to your HCH? I'm experiencing the identical problem on my '06 HCH and getting the same runaround from my local dealer. If I go back to them with some specific updates that need to be done, they should be more cooperative.
