Is it better to buy new or used at the moment? Does the credit crisis mean that used cars are going fast? Has anyone negotiated a great deal on a used car recently?

Please tell us that you put the deposit on a credit card. Then it's easy to get it back. Just call your credit card company and dispute the charges.
Not sure how to go about it if you paid cash/check.

As Verdugo said above it should be easy to reclaim if it was on credit card because your broker has not delivered (or incurred) any of the things that the deposit was supposed to cover.

That would be easier, and smarter. But it wasn't on a credit card. So I need a recourse considering that fact, which is more difficult. It may just be a small claims court thing, but I was trying to avoid that.

Sorry to hear that. I am not a lawyer, so absolutely don't consider this legal advice. This is how I would handle it:
* Contact the manager at the broker service
* Contact your local tv news station. You know, the one that investigates consumers complaints. Not sure how effective this would be since it might not be a local company.
* File a complaint with the BBB
* Small claims court

At this point, I'd send the guy a nicely worded professional letter via registered mail, indicating that as per the legal contract terms you are officially demanding your money back to be received within 14 days (unless the contract terms state something different), and if they do not comply you will have no recourse but to immediately submit the case to both the BBB and small claims court.
I'm assuming you have some legal contract that you both signed, as well as some proof of your deposit.

There isnt really an exact answer to your question....Alot depends on your buying goals. Some used cars offer great opportunities right now. A late model full size SUV can be a bargain but a super clean small car like a Mazda3 or Civic will be top dollar. There is a toyota dealer in my area that is selling 2 year old prius's for the same price as new and people are buying.
If you can be specific about what kind of used car your considering it would help the discussion
