Car Swap by mds2400

I have a Jeep Grand Cherokee and live in CO. My father-in-law has a Ford Expedition and lives in MN. We are trading so that Ford will be ours and my father-in-law plans to trade our Jeep in for a new car. Both cars are being financed. Is there a way to avoid paying sales tax on all three transactions? For example, can he sell me the Ford for $0? Or, can we simply just transfer ownership? Thanks.

On the Grand Cherokee? Just give him a power of attorney and the title, and let him give it to the dealership... They should take care of paying it off and crediting him with the balance against his new car.. In other words, the car's ownership should never pass to him.. Worst case.. they cut a check to you for the difference between trade-in and payoff, and you sign it over to him.. He may lose out on any sales tax credit on the trade-in (assuming that applies in MN).
(disclaimer: If any of this is illegal, don't do it).

On the Expedition? He can probably give it to his daughter (your wife) tax-free.. and get her a Minnesota title (it works that way in my state). Whether she can take that Minnesota title and re-register it in Colorado without paying sales tax is another matter... You'd have to ask your local DMV..

Giving cars to family members can usually be done without incurring sales tax.. Selling them usually is a taxable event, no matter the relationship.. That's something to keep in mind..

AZ tax for OR resident? by samiam10

I'm an Oregon resident (no sales tax) who wants to buy a new car in Arizona (sales tax) during a visit next month.

The AZ dealer I talked to suggested that I pay the tax and then ask OR for a refund. That seems a difficult approach.

Is it possible to purchase a new AZ car with no sales tax, drive immediately to OR, and then title/register the car in that state?

Thanks,

As an Oregon resident, you would not pay the 5.6% AZ state tax.
What you would be liable for is any city and county tax.
FAIK, there is no refund for this from Oregon.

You know he said you have to pay the City or County tax which is about 7% of the car. You would always need to pay sales tax in the state you purchase when driving the car out of that state. if you are trucking the car out of the purchasing state, it would be tax exempt in the purchasing state. You would still be liable of the use tax in your home state.

Actually, in most places city and county is only 2% or so.

Don't paint with such a broad brush. While it may make a difference in some states, whether a vehicle is driven or shipped has nothing to do with tax liability in many others.

Sales Tax on a Totaled Leased Vehicle by dlynch

Here is the situation:
1 - I leased a 2008 Toyota from Toyota Financial Services
2 - My son totaled the vehicle. Fortunately he is ok, unfortunately he was not covered under our insurance policy.
3 - I had to buy the vehicle from TFS for $25,0000 to clear the lease.
4 - I will sell the vehicle to the salvage yard for $1,000.
5 - I live in PA and in order to transfer the vehicle to the salvage yard, I have to give them the title.
6 - Does anyone know if I would have to pay PA sale tax on the $25k purchase price of the vehicle?

Any thoughts are appreciated.

does this vary by state? I know here in NJ, my car is covered by my insurance no matter who is driving.
I mean, otherwise, what would they do in the event of theft? "Hey, you were driving when the thief drove your car off the bridge. Too bad!"
