Ok, I think this applies to both of you. Based on my 2 trips to NJ traffic court, you will not get a chance to speak, regardless of your plea. More importantly, pleading guilty will not even get you a trip in front of the prosecutor. You must plead not guilty and go see the prosecutor. He may ask you a question or 2, but, most likely, he's just going to inform you of the deal he is offering and if you accept or not. That's it.

Replying to: his01 (Apr 11, 2005 1:00 pm) Once I had got a 4 pointer (52 in a 35) and my lawyer, who did not come cheap, had it knocked down to a 0 pointer (faulty equipment). If you need help with finding a lawyer, try the national motorists organization website. They also have a few good resources regarding fighting tickets. Or, just look up traffic attorneys in the yellow pages. Finally, fix that defective headlamp. You do not want to draw attention by having faulty equipment. |

You might catch the prosecutor in a good mood and get it knocked down to careless driving, which, if i remember correctly, cost a bit under $100. Then again, that was a few years ago, so who knows now? If you get it knocked down to 2 points, I would think chances are you'll still pay less than $204, even after court fees, etc. BUT, maybe they'll want to hit you with a 2-pointer AND a no-pointer/high-fine ticket for good measure. You just never know. |

I got a 2 point speeding ticket and I pleaded not guilty and appeared in court and made a deal with prosecutor to reduce my 2 points. This was my first traffic offense. But if I had not appeared in court would the first two points still affected my insurance premium?
