Help me too! by newbie05

Hi everyone. I hope someone could give me some advice. I am 23yr old male. This coming august would mark the end of my 3rd year with a license with a clean record. But unfortunately, I just got a speeding ticket on the garden state parkway. It was a 65mph zone. I was going 84mph. 19 miles above the limit. I think it's 4 points, but i'm not sure. It might be 2 points. Is it possible for me to bargain plea it down to nothing and just pay more money up front? And if its 2 points, will insurance companies overlook it? And lastly, if i do a bargain plea, can it backfire? As in, the judge doubling my fines? I am so upset, because I was only going that fast because there was a guy tailgating me. I was just planning to pass the guy to the right of me so I can switch into his lane and let the speedy guy that was tailgating pass me. Someone please help. I would greatly appreciate it. Thanks!

I am sorry to hear about your recent speeding ticket, newbie05. This sounds like a four point ticket to me. While it definitely is a good idea to go to court and try to plea bargain your speeding ticket down to a lesser offense, chances are that you will only be able to get a four point ticked reduced to two points, rather than a no point offense. Still, a reduction of two points is better than nothing. You don't have anything to lose by going to court. You won't even deal with the judge until after you speak with the prosecutor and they aren't going to just double your find out of spite because you want to see if they will work with you. Unfortunately, your insurance company will not overlook a two point ticket. It will likely have a negative impact upon your rates.

It is a 4-pointer. 1-9 mph over is 2 and 10-19 is 4. As the host said, no points is most likely not going to happen. As far as your insurance, it really depends on the company. If you are with NJ Manufacturers, for instance, 2 points won't affect you.

I got a ticket for "Careless Driving" in NJ
I have a very good driving record - no points, and I want to keep it that way
If I plead not guilty, will they reduce the charge to a no-points, no surcharge offense when i speak to the prosecutor?
Thanks in advance for any advice

well, of course, nobody can predict what will happen when you talk to the prosecutor. Best you can do is go give it a shot.

You may very well be better off having the tickets separate like this. If you went in to court staring down the barrel of 6 points, you'd probably walk out with 4. BUT, since these are separate, you may be able to go to court for the careless and walk out with a no-point violation. Then go back for the 4-pointer (or is that a 5??) and walk out with 2. However, I'm not sure you'll be able to get that 4-pointer knocked down (since its 20 mph over). Again, all you can do is go try.

Thanks gbrozen,
I am having these two tickets in different courts with different dates..

Here is what I have prepared my case..will this work?

Please help

I am driving since Dec 2000 in US and did not get any driving offence in 4 and half years in spite of driving history with 20000+ miles average per year.

Recently I got a driving ticket on 3/26 as "CARELESS DRIVING" ticket because police man told me that I was driving very close in lane and switched the line without indicator..

I did not drive for 4 days continuously when I got my first ticket.. And when I re-started my driving. I became so careful in my driving (following all the posted traffic signs and speed limits) because I didn't like that I got a ticket on my record even I consider myself a responsible driver..

Then again in the gap of just two weeks I got another ticket on 4/9 evening when I was driving back to home from an Indian store.

On 04/09 on Plainsboro road, I was driving at 40 in the speed zone of 40 and suddenly I noticed that one police car started following me. This car was on my left side and moving taking U turn toward my car. I got scared as well as more conscious and started driving slower than before to do that I pressed the break. After "" miles 25 mile zone started and I slowed down to match 25 speed limit.

I noticed that police car is just behind me for more than "" miles. I started praying god that I should be ok because of my last traffic ticket incident. In fact I started shivering.

When I was pulled over by cop's car, I stopped my car and police officer very politely started with these few question...

Do you know your head one head light is out..? I said.. Yes sir this is happened just today.

He asked for my driving license/insurance and registration. Which I presented immediately.

I was so scared in answering all the questions to police officer.

He said that you were driving at 45 in 25 miles zone..Did you realize that?

I answered NO SIR.. As soon as I saw 25 mile zone sign, I slowed down my car to 25mph.

Police officer told me that there are 6 posted signs on this road which say 25mph....

I kept quite at this point leaving everything in god's hand. I was pretty sure that I did not make speeding offence.

He then asked me about my driving history. I explained about my last ticket which I got two weeks before..

Police office told me that he is going to check my license history and he will be back soon..

I quietly sat in my car and waited for officer to come back..

Officer came back in about 6-7 minutes and told me that he is giving me ticket for driving 45 miles in 25mph zone..

I requested the officer to reconsider that case

I was denied by officer that ticket can not be UNDO..

I am confident that I can not drive 45 in 25 mph zones especially.. Right after getting the ticker two weeks back. Therefore I am confidently pleading NO GUILTY.

PLEASE HELP HOW TO DEAL WITH THIS TICKET??

Thanks a lot Car_man host. I appreciate it. I think i'm going to plead not guilty and then goto court and plead guilty. Hopefully they'll minimize the points. Thanks again for your help
