So I had my dream Accord a total of a month and a half. I was driving home from the hospital after a 12 hour shift it was about 530p, and coming down a two lane each way highway guess what happens. A man in a 18 wheeler turns in front of me. I jam on the brakes and swerve right to avoid hitting the semi. I hit the curb at about 55mph and jumped it, slamming back down onto the road he was turning onto. I slid in front of him and across that road, before hitting another curb and sliding the accord down an embankment. The police department issued the SEMI driver a ticket for failure to yeild, and leaving the scene of an accident. Yeah he drove off. The guy behind me chased him and called the PD. Both witnesses backed my story and I was found not at fault.
  
Now, about my baby. Could anyone take a stab in the dark as to what could have all been damaged by this kind of impact. The car drove onto the flatbed, just with two flat tires up front and the front rims damaged. Car was still running when I came to a stop. I was wondering if the curb could have caused frame damage? Anyone think it might have? And do you all think the the suspension could be jacked up? Anyways... today sucks... I lost my baby, hopefully not permanently. Be in the end she kept me safe. GO HONDA!!!

Rare Motorcycle totalled by bob311

I just received a Italian motorcycle that I had been searching for 2 years....Color Italian red, mileage, just over what is allowed to be imported into California (7500 min. had 7521).
The KBB shows $7995 for this bike, but they are not made anymore (Since 2004), not available except for a few high mileage or Salvage titled bikes in CA.
Repairs due to parts looks like about $8000. Mechanically the bike was perfect on the laser alignment. All the damage is front end plastic, and supports. The adjuster refused to look at the bike at my residence and required me to take it to a shop, and for them to perform an estimate. (Cost about $800 so far).
 
Since this is a 3rd party settlement, how can I force the company to make me whole??? It is not possible to purchase the same bike in California, and they would prohibit the importation of an out of state bike that had less than my mileage at time of accident.
 
I am patient so do not care if it takes some months.
 
Also I am happy to do my own repairs if we reach a settlement.
 
Suggestions....

I was involved in a accident on Feb. 25, 2007, Someone turned in front of me and I hit them head on. The accident was ruled the other persons fault. My airbags never deployed although we were traveling around 40 mph upon impact. I am looking over copies of the repair bill which was around $10,000 in damage. They repaired stuff normal cosmetic stuff and I also notice where they had to replace the engine cradle mounts on both sides in the front and reinforce the side rail. I am wondering if I should really be concerned about this??? Toyota now has my car and they are investigating the airbag issue. The front of my car looked like I had hit a tree and even the bodyshop was a little surprised that the insurance company did not total the car. I am pregnant and have two small children. I don't feel that I will ever feel safe in my car again. What can I do???

Unfortunately since the repairs have already been done I don't think there is anything you can do. If you wanted to argue as to weather or not the car should have been totaled that probably should have been done prior to the repair process starting.
 
I may be wrong though, I don't work in the insurance industry

With an older car I assume that the magic number for being "totaled" can be reached with relatively minor damage.
$1000 or $1500 of damage might be enough to exceed the wholesale value of say a 10 year old car.
 
If your car is totaled by the insurance company do they simply pay you the low wholesale value and then take the car or do they let you keep it?
 
If the damage is mainly cosmetic I could see putting some money into making it road worthy and forgetting about the appearance. However, if the insurance company takes the car you would be out the difference between wholesale and retail cost.
 
What do the experts think?

No they don't let you keep it. They get salvage bids on the car and sell it to recoup part of the claim. Itis not uncommon for people to buy back there car though on the salvage bid.

I bought a NEW 2006 Nissan Xterra two weeks ago. It had 1400 miles on it. I financed it, but did not purchase GAP insurance--though I do have good insurance coverage with USAA. Yesterday, a young man, with a SUSPENDED license, NO insurance and an out of date tag, ran a redlight going 50-60mph and I plowed into him. The airbag saved my life, but I'm pretty banged up--with bruises all over. The police gave him two or three tickets but let him go without giving him any alcohol or drug tests. There were a ton of witnesses that saw him run it and he was deemed totally at fault.
 
My questions is, IF my truck is totalled, how much can I expect to get for it--is it used retail, private party or trade-in? The truck was brand new!!
 
Also, is there any way I can get the kid to pay my deductibles and the difference that GAP would have paid?
The police told me that even if I hired a lawyer, there was no way to "squeeze blood out of a turnip"!
 
What if he has no money or assets? Am I just out of luck--as if he'd taken a few thousand dollars out of my pocket, set it on fire, and walked away?!?
 
IF they do repair it, but it's just not the same and has repeated problems, is there anything I can do about it?

Your insurance company should pay (minus any deductible) what the vehicle is worth (used retail). It may have been "new" when you bought it but it was very definitely used at the time of the collision.
 
People who have assets or money don't drive on a suspended license without insurance so, yes, you're SOL. Sorry, life isn't fair.
 
As for your last question, push hard to get the thing declared a total loss so as to avoid a variety of potential future issues.

Depending on your state, you may get a new vehicle or full value of it. I'm fairly sure that within the first year some states require insurance companies to replace the vehicle if it is totaled in the first year. This is to prevent that GAP issue. Definitely do some research on what your state laws are on insurance.
