I don't know whether it's legal for your dealer to cash your check but the question really is whether your down payment is refundable. If so, then it makes no difference whether the check was cashed and you should receive a refund upon their failure to deliver the product you ordered. tidester, host |

If I were you, I'd go first thing Monday morning to my bank and put a hold on that check. Then I'd go to the ignorant salesman and demand my check back. Then I'd go to another dealer and talk to a salesman that doesn't treat me as a dumb person. I'd like to know the name and location of the dealership. |

| I had similar situation where refundable deposit was in question. Went to one dealer who said deposit was not refundable at all. Went to a second and they said no problem, even hand write it in our contract to say the deposit is refundable. If for some reason my wife and I do not want the car, salesman said he will have no problem selling it to someone else. Ain't that the truth. | |

each region chooses the packages to stock on a regular basis. it's possible that the package that you're looking for isn't a standard package that's available in your area. if your dealer isn't willing to do so, find another dealer that's willing to either special-order the package that you want, or will look into doing a trade with another region for the car that you are looking for. |

Regarding the refundable deposit. It depends on your states common law as to what remedy you get, but most of the time you get at least your deposit back. From a contracts perspective if the deposit is a true deposit (meaning you are paying the dealer to deliver the car), if the the dealer fails to deliver and won't refund your deposit, you can sue for the difference between what you had to pay at another delaership and what you would have paid at the dealership holding your deposit, plus court costs and your deposit (it is highly likely it will never make it to court). If in your state the money you gave the dealer is construed as a good faith indicator (meaning its merely an indicator of your commitment to buy the car), then if the dealer gives a good faith effort to obtain the car and doesn't deliver, then they owe you the deposit back and nothing more. If your dealer tells you your deposit is not refundable under any circumstances, I'd bet good money he's lying or not willing to back that up. Have a lawyer write a letter to the corporation and 99.9% of the time I bet they'll settle for two reasons, 1) Its really bad business practice; and 2) The common law is likely against them. You will have an issue recovering in court however if you signed a contract had explicit terms as to the non-refundable nature of the deposit, though depending on your state this may not make a difference if the state specifically prohibits making deposits non-refundable. See Paloukas v. Intermountain Chevrolet Corp. Supreme Court of Idaho 99 Idaho 740, 588 P.2d 939 (1978) and like cases for more info related to this. |

| I just got my prius last night (whoohoo!) and while driving home, realized there's no cruise control. After looking in the brochure I noticed it's not offered as an option. Is there a reason for this? Is it because your fuel consumption is increased by trying to maintain a certain constant speed? Would I be able to add cruise as an after market option or would this be a bad idea? Also, the tint on the windows were not at all as dark as the pictures I've seen and I really like the dark tint. How about aftermarket tinting? Is there a certain tint technique or brand that is best? By the way, those are the only complaints and they're pretty minor....I LOVE the car!! | |

> it's not offered as an option That's because it's standard. You likely didn't find it on the car itself since each automaker puts it in a different spot. The photos I've taken of a 2004 clearly show that it is installed in the same place as the classic model. Look behind the steering-wheel to the right, at about the 4:00 position. The stalk sticking out is the cruise. JOHN |

maggie: to expand on john's comment above, the cruise control stark shoud be labeled --on/off, acc/res, set/coast ect. congrat on the purchase! keep us posted on your experience. i cannot wait to actually see one in person and hopefully putting down the purchase. |
