Very sorry to hear about your accident. With regards to your daughter, it is extremely important that you get her to a chriopracter as soon as possible. About 6 years ago, I was rear-ended in my 89' Corsica by a car doing about 80 kmh (I was at a standstill). The hit was so hard that the front seats were fully reclined (ie. pressed against the back seats) after the hit. They never worked the same again. However, more to the point... I swear my back has never been the same since. I never went to a chiropracter after the accident, and I regret it seriously. Now when I sit a desk for long periods of times, my back hurts. Dana- Sounds good to me! Kate- Condolencences. I am not familiar with the laws in that state, but in MD and TX the driver who does the rear ending is liable for the entire wreck. That would make a "setup" in this case unlikely. However, you can forget about the other guy's insurance. I was in an accident in TX under similar circumstances (demographic and otherwise-including cop's indifference...actually, he was downright surly with me). The other guy bought a month's worth of insurance just to get the card, then let it lapse. He had "proof" of insurance at the scene, but turned out to be uninsured. This was the second uninsured driver to hit me that year, so State Farm dropped me (which they can do in TX but not MD because of deregulation there- looking forward to Bush yet?) and sent me packing for a high-rate insurance company. I was 23 at the time and poor as dirt. I will NEVER as long as I live go back to State Farm. The car was totalled, the other driver was calling me and threatening my life, and State Farm made a bad time much worse. Also, it is important to take your daughter in. You may end up filing for uninsured motorist under your policy, but if by some miracle the guy actually has insurance, her bills will be covered. |

Thanks. glad you liked it the lil' article! I lost out on that 325is. Plus Q and I figured a four door would be a more practical daily driver. I am keeping my options open at this point, but an '86 535i is about the same size as a '99 Legacy sedan. We drove a 535is on Sunday that was beat. No "Ultimate Driving Experience" there. Last night's test drive was night and day- perfect interior, and gobs of power and torque in a well-maintained vehicle. Amusingly, the engine reminded me of a Phase I on steroids-- same pokiness at low revs, but get it past 3000 rpm and...well, with 2 more cylinders and 35 more horses, let's just say it was very easy to get felonious without even noticing! The seller is quite proud of it, and that is reflected in his price-about $600 over reasonable market value. I am having the car inspected tomorrow and may make an offer at that time, if it checks out. |

Dana: sounds like quite an idea. At some times during the day we're so active it's like a virtual chat anyway. The key question is when? Maybe Bonnie has tools to figure out what time of day and day of the week are busiest with the current software (doubtful?). Your humble Crew Chiefs (Mike Smith and myself) could host a session, though I wouldn't object to any other regulars doing the same. We have to account for different time zones. Early AM here on the east coast is way too early for our west coast collegues, so maybe east coast PM would work best. Maybe 3pm here, noon there? Loosh: good point, in most states if you're hit from behind it can't be your fault. Just keep good records and those photos, take notes even. On an engine that old, make sure they check the compression. You don't even want to get into it if the piston rings are shot. Though it sounds like that first one was more likely to have that problem. -juice |

Thank you all very much for support and sympathy expressed. Just a small clarification: I might have come across as someone more concerned with the car than with a child, but this is only because I did not want to sound as yet another "lawsuit-happy" citizen who is eager to claim any injuries, just to sue someone. After living in California for past 10 years, I developed a great distaste for such people, and did not want to even remotely appear similar to them. I'm taking my daughter to a doctor today. She says she feels better but intermittent headaches and sore skull are still present. Good thing, we had a headrest mounted on the back seat! I'm afraid even to think of what could've happened to her neck, if she was riding w/o the headrest. Not much update otherwise. My insurance (State Farm) could have been a bit more proactive. So far, I was the one finding information for them, not vice versa. I located and contacted the other guy's insurance in AZ, and thank God, his policy was still valid (it was bought for 1 mo indeed, but only 2 days before the accident). They said, however, that they could not contact him because he left wrong (non-existing) phone and address on file with them. Now they have to wait for police report, to confirm my story. Needless to say, that "responsible driver" never reported the accident to his insurance. Anyway, I filed my reports in writing and claims with both insurances. Today the photos should be developed, to complement my story. I found out the name of the supervisor of the cops on the scene, and want to complain about their behavior to him. Will try to follow juice's plan and buy parts from Darlene, but will need to check with body shop, if they'd accept such parts. They probably make a hefty profit on parts, so that may not fly with them, but I'll check it out. Having an old trusty Loyale around helps a lot, at least I don't have to use rental cars which I usually hate. Forester is sort of driveable, but with the tailgate hanging on a duct tape, so I'm not taking chances with it. |

Ouch! Sorry to hear about your accident. I hope everything turns out OK with your daughter, and best of luck resolving things with the insurance companies. It's not easy dealing with that baloney, and I sympathize with you. Craig |

Kate: glad to hear you seem to have a well organized plan. Thankfully his insurance is valid; it's their problem to find him. Hopefully they'll contact the DMV and void his registration. I agree that you should not drive the Forester until it's fixed. -juice |

I don't think anyone thought you cared more about the car. It was merely a case of a few of having gone through this before, and knowing that medical records are key to getting the settlement you deserve. So no worries, m'kay? |
